Brazil’s Secretariat of Prizes and Bets has opened a public consultation to gather feedback on proposed changes to the authorization process for companies seeking to commercially operate fixed-odds betting in the country.
The Secretariat of Prizes and Bets, known as SPA and operating under the Ministry of Finance, published Public Consultation Notice SPA/MF No. 3/2026 in the Federal Official Gazette on July 22. The consultation will help shape an ordinance establishing rules and conditions for obtaining authorization to operate the fixed-odds betting lottery modality.
The contribution period will run for 45 days, beginning on July 27 and closing on September 9, 2026. Individuals and legal entities may submit comments through the Brasil Participativo Portal.
Once the consultation closes, SPA will analyze the submissions in accordance with Article 31 of Decree No. 12,002 of April 22, 2024.
The process forms part of the regulator’s continuing work on the framework governing Brazil’s regulated betting market and gives interested parties an opportunity to contribute before revised authorization requirements are finalized.
SPA Prepares Review of Existing Authorization Rules
The consultation is intended to support changes to the procedures that betting operators follow when seeking authorization in Brazil.
Current requirements are addressed under SPA/MF Ordinance No. 827/2024, which established rules and conditions connected with authorization to operate betting activities under Brazil’s betting legislation.
The new consultation will provide SPA with information that can be used when revising those requirements. The regulator intends to take into account experience gained during the first authorization cycle as it considers changes to the existing framework.
The review covers the rules governing authorization for fixed-odds betting operations, including sports betting and online games permitted within the regulated market.
According to iGaming Brazil, Public Consultation Notice No. 3/2026 was issued under powers established through Decree No. 11,907 of January 30, 2024. The notice also refers to Law No. 13,756 of December 12, 2018 and Law No. 14,790 of December 29, 2023, alongside provisions contained in Decree No. 12,002/2024.
The formal notice states that the consultation seeks contributions and information that will support preparation of the ordinance governing commercial authorization for the fixed-odds betting lottery modality.
Participation is open to both individuals and organizations. Interested parties must use the Brasil Participativo Portal and access the consultation through their gov.br credentials.
Consultation Follows SPA Regulatory Agenda
The authorization review was included in SPA’s Regulatory Agenda, established through Ordinance No. 817 in April 2025.
That agenda anticipated a review of the authorization procedure for betting operators during the first quarter of 2026. The consultation has now moved that process into its public participation stage.
The 45-day window gives stakeholders until September 9 to submit comments before SPA begins assessing the contributions.
The regulator will then consider the material received when preparing revised authorization rules. The process gives businesses affected by the licensing framework, as well as other interested participants, an opportunity to provide information before the new ordinance is completed.
The review comes after Brazil implemented its regulated fixed-odds betting framework and began processing operators through its first authorization cycle.
Experience from that initial process will inform SPA’s consideration of possible changes to the authorization procedure under Ordinance No. 827/2024.
The consultation therefore represents another stage in the development of the administrative framework governing companies that want permission to operate within Brazil’s regulated betting market.
Government Expands Focus on Licensing Transparency
The consultation also comes as the Ministry of Finance takes additional steps related to transparency in betting authorization procedures.
In June, Finance Minister Dario Durigan announced that the ministry planned to publish more than 25,000 documents connected with betting licensing. The measure was presented as part of the government’s effort to increase public access to information about the authorization process.
The Ministry of Finance subsequently issued Administrative Order No. 2,126, which created a task force focused on transparency in licensing procedures involving gambling companies.
The public consultation adds another element to that wider regulatory work by allowing interested parties to contribute directly to the rules that will govern future authorization applications.
SPA will accept submissions throughout the period from July 27 through September 9. After the deadline, the regulator will review the contributions under the procedure established by Decree No. 12,002/2024 before moving ahead with the proposed ordinance.
The resulting rules are expected to revise the framework used to evaluate applications for authorization to commercially operate fixed-odds betting in Brazil, taking lessons from the country’s first licensing cycle into account.
