A federal judge has temporarily allowed Stake to resume operations in Brazil until October 25. The judge suspended website blocking measures while rejecting the company’s request to continue operating through 2029.
The court ruling was rendered on October 8 by Judge Cristiane Farias Rodrigues dos Santos of the 9th Federal Civil Court of Brazil, which suspends all blocking actions related to the gambling platform.
Stake requested the court to suspend the ruling and allow operations to continue until December 31, 2029, the date until which the original permission was given. The judge denied the requests but provided a temporary reprieve stipulated in the court ruling.
The authorities cannot punish Stake only for the fact that the company is still operating within the limits of the court decree. A ban on blocking or interfering in operations of the authorized site or technology related to the platform functions is imposed as well since such measures are only based on canceling the platform’s authorization.
Stake must meet regulatory requirements
The court attached conditions to the temporary authorization, requiring Stake to maintain player-protection and regulatory controls. These include:
- Maintaining player identification and verification.
- Preventing betting by persons prohibited by law.
- Prohibition of using social assistance funds for betting.
- Banning advertising to children and teenagers.
- Refraining from launching new advertising strategies aimed at expanding the user base.
- Allowing customers to withdraw their available balances and maintaining sufficient funds to cover them.
- Preserving customer registration, financial and transaction records.
- Continuing to submit reports required by regulators.
- Operating only through authorized domains.
- Preventing the ruling from being used to legitimize illegal operators or unauthorized third parties using the Stake brand.
- Maintaining measures against fraud, falsification, trademark misuse and unauthorized operations.
The ruling gives a temporary relief rather than an immediate annulment of the federal measure. As for the legal counsel of Stake, this ruling is the first such judicial decision in favor of the fixed-odds betting companies in court disputes over the implications of the Provisional Measure No. 1,394/2026.
The implications of Stake’s ruling are still uncertain; however, judicial rulings do not restrict application of the measure to other operators.
