A Floridian who believes he contracted the potentially deadly Legionnaires’ disease during a stay at Wynn Las Vegas has filed a lawsuit against the Strip resort, which recently announced it will bid farewell to the technologically ambitious production “Awakening” next month.
The man is accusing the casino of failing to take the proper measures to protect guests from exposure to the bacteria.
He Wants $30,000 in Damages
Ruben Feliciano filed the lawsuit in Clark County District Court last month, on August 25. He is looking to obtain more than $30,000 in damages, money that would cover both his medical expenses as well as the alleged permanent injuries that he suffered as a result of his exposure to the bacteria.
The lawsuit claims that Feliciano became ill during his stay at the casino at the beginning of the year, in January. After he went back to Florida, the condition of the man reportedly became so serious that it required hospitalization for three days, from January 22 through January 25.
A few months later, Feliciano says he received a letter informing him that he may have been exposed to Legionnaires’ disease during his stay at the resort.
Throughout his lawsuit, Feliciano wants to prove that the resort didn’t perform the proper cleaning and maintenance procedures of its property, nor did it warn him about possible exposure to the dangerous bacteria.
Moreover, the lawsuit claims that the alleged exposure resulted in serious and permanent injuries that keep affecting some of his occupational and recreational activities.
Health District Investigated Two Different Cases
The allegations follow a separate investigation by the Southern Nevada Health District into travel-associated Legionnaires’ disease cases connected to Wynn.
In April, the health district said it was investigating two cases involving people who had stayed at Wynn in September 2025 and February 2026. Both individuals had recovered, according to the health district.
Environmental testing found Legionella bacteria in multiple samples collected at the resort. Wynn was quick to fix its water system, notify guests about possible exposure, and carry out follow-up testing.
The health district later said that the most recent samples from the affected areas showed no detectable bacteria.
Legionnaires’ disease is a serious form of pneumonia caused by inhaling tiny droplets of water containing Legionella bacteria. According to the Centers for Disease Control and Prevention, people over 50 and current or former smokers are among those at higher risk.
The health district has not yet confirmed whether Feliciano contracted the disease at Wynn.
In March, a different lawsuit connected to a guest’s death was filed against Harbor Island Apartments (now The Harmon at 370) and Coast Hotels and Casinos, responsible for operating The Orleans Hotel and Casino.
