The UK Court of Appeal has ruled against The New Lottery Company Limited (TNLC) and Northern & Shell PLC, denying their request to appeal an earlier High Court decision. The two parties will also no longer be able to file further appeals, hopefully marking the end of a lengthy legal battle. The UKGC Stressed That the Bidding Process Was Fair
The dispute centers on the UKGC’s decision to award the 4th National Lottery license to global operator Allwyn. This decision drew the ire of billionaire media mogul Richard Desmond, who argued that the UKGC had given Allwyn an unfair advantage by providing feedback during the lottery license application process. Desmond’s New Lottery Company eventually took the matter to court.
While other bidders, such as previous license holder Camelot and technology company IGT, also challenged the UKGC’s decision, they eventually backed down. Desmond’s company refused to relent, seeking GBP 200 million ($269 million) in damages. Despite TNLC’s claims, the UK regulator defended its position, describing it as robust and thorough and dismissing the allegations against it.

The judge dismissed all three grounds of appeal, prohibiting TNLC from raising a new legal challenge. The court noted that the plaintiff had not suffered any practical damage and that the company’s chances of actually securing the license were very slim to begin with. The UKGC welcomed this decision and remained optimistic about the future of the UK lottery.
