Gambling Regulation Roundup: Nebraska, Haiti, Brazil

Illustration of a ballot slip dropping into a ballot box, a gavel and a stamped decree in front of a courthouse with columns, with a globe and a padlock in the backgroundThis roundup covers gambling regulation developments from 3 to 7 November 2026. Nebraska voters have rejected online sports betting, Haiti has created a national gambling regulator, a Brazilian appeals judge has let three betting sites resume, Mozambique has published its online casino decree, and the EU standstill on Austria’s draft gambling law has been extended.

Nebraska (United States)

Voters rejected both ballot measures that would have legalised online sports betting at the 3 November 2026 general election. Initiative 440 was a constitutional amendment to authorise online sports wagering, and Initiative 441 was a companion statute with the regulatory framework and tax structure. Both had to pass. As WOWT reported, Initiative 441 failed by 54.5% to 45.5% and 440 was defeated by about 55% to 45%. These totals are unofficial until certified by the Nebraska Secretary of State.

WOWT said Tax Relief Nebraska, a coalition backed by state casinos and online sports betting groups, spent more than $22 million. Opponents included the Nebraska Family Alliance. Senator Pete Ricketts, who was re-elected, said: “We were being sold a bill of goods about the online sports betting.”

In-person retail sports betting stays legal at licensed racetrack casinos, approved by voters in 2020, while mobile and online wagering remains illegal statewide. CND noted in its 4 November roundup that the count was pending. The state-by-state position is in CND’s guide to US gambling laws.

Haiti

Haiti’s Ministry of Economy and Finance (MEF) has announced a national gambling regulator. In a public notice dated 5 October 2026, it said decrees fixing the rules of the sector were published in the official journal Le Moniteur on 21 August 2026. The notice says the decrees create a new state institution, the Autorité Nationale des Jeux de Hasard et d’Argent (ANJHA), with power to control and monitor the sector across the whole country, and make the Direction Générale des Impôts (DGI) the only place where businesses in the sector pay taxes and duties.

iGaming Business reported that three decrees establish the regulator, set its operating rules and create a gambling tax regime. It said ANJHA covers casinos, betting and borlette banks, is based in Port-au-Prince and will publish a list of authorised operators. iGamingToday alone reported an annual licence fee of five million gourdes for online operators and a monthly payment of 5% of gross gaming revenue; those figures rest on that outlet’s reporting only.

No source says when ANJHA will start operating or who will lead it, and the future of the Loterie de l’État Haïtien, which CND’s guide to gambling in Haiti describes as the de facto regulator, has not been stated.

Brazil

Federal appeals judge Adriana Pileggi of the Federal Regional Court of the 3rd Region (TRF-3) in São Paulo has granted interim relief on appeal to CDA Gaming Ltda, which runs Casa de Apostas, Betsul and Jogo Online. The decision sets aside, for this company only, the extinguishing effects of article 4 of Provisional Measure 1,394/2026. Press reports say it was signed on 3 November 2026, and Agência Brasil reported it on 6 November.

CDA Gaming paid R$30 million for a federal authorisation valid until 31 December 2029. A lower court had refused interim relief. The judge called ending authorisations without refund or compensation a “verdadeiro confisco” (true confiscation) and found breaches of legal certainty, reasonableness and proportionality, according to Migalhas.

The decision applies only to CDA Gaming. All other operators remain barred, and the Attorney General’s Office (AGU) has said it will appeal. The Supreme Court held a ten-hour hearing on the ban on 3 November, which CND covered, and has issued no ruling. See CND’s guide to gambling in Brazil.

Mozambique

iGaming Business reported that Decree No. 61/2026 of 21 September 2026 approved the Regulation on the Operation and Practice of Online Games of Chance. It enters into force 60 days after publication, on 20 November 2026.

Concessions go only to public limited companies incorporated in Mozambique, with minimum share capital of MZN 100 million and, where there are corporate shareholders, at least 26% of paid-up capital held by Mozambican shareholders. Operators make two contributions of at least 2.5% each of annual gross revenue less winnings paid. Licences run for two or three years. Payments must be in meticais, operators need a .mz domain, and when the IGJ finds an unauthorised service it orders removal within 48 hours and then notifies intermediaries, who normally have 48 hours to block it.

The decree gives no date for applications to open and no launch timetable. CND’s guide to gambling in Mozambique has the wider framework.

Austria

The EU standstill on Austria’s draft gambling law now runs to 7 December 2026 rather than ending on 5 November. The TRIS record for notification 2026/0415/AT lists Malta as issuing a detailed opinion and the European Commission as issuing comments. Under article 6(2) of Directive (EU) 2015/1535, a detailed opinion extends the standstill to four months, so Austria cannot adopt the law before 7 December and must report to the Commission on the action it proposes.

The texts of Malta’s opinion and the Commission’s comments are not published, and the record does not give Malta’s reasons. It lists two stakeholder contributions, from Aleatrust GmbH on 7 October 2026 and from DORDA Rechtsanwälte for Allwyn AG on 27 October 2026.
